General conditions of sale
Article 1 – Scope
These General Conditions of Sale (hereinafter the “CGV”) are concluded between the company VARA EQUIPEMENTS , a simplified joint stock company (SAS), registered in the Nîmes Trade and Companies Register under number 106 233 810 , operating the commercial brand Vara-Équipement , hereinafter referred to as “the Seller”, and any natural or legal person (hereinafter the “Customer”) wishing to make a purchase via the site https://vara-equipements.com or by any other ordering medium (quote, order form, email, etc.).
These General Terms and Conditions apply to all orders placed on the site, both by private consumers and professional customers.
The Seller reserves the right to modify these General Terms and Conditions at any time. The applicable General Terms and Conditions are those in force on the date of validation of the order.
Article 2 – Products
The essential characteristics of the products are described on the site. The Customer acknowledges having read it before placing any order.
Additional information can be requested before ordering by email.
Despite the care taken in drafting the product sheets, errors or omissions may remain, without prejudice to the applicable legal guarantees.
In accordance with current regulations, certain products cannot be returned, exchanged or refunded, in particular:
- food products (spices, casings, chocolates, colorings, etc.);
- vacuum bags for sanitary reasons;
- books.
Article 3 – Order
Any order implies full acceptance of these General Terms and Conditions.
After validation of the order, a confirmation e-mail is sent to the Customer, serving as acknowledgment of receipt.
The Seller reserves the right to refuse or cancel any order in the event of a prior dispute relating to payment.
The information communicated by the Customer when ordering is his responsibility. The Seller cannot be held responsible for the consequences of errors or omissions.
In the event of an exceptional out of stock, the Customer will be informed as soon as possible and will be able to choose between waiting, a credit or a refund.
Article 4 – Price and payment
Prices are indicated in euros.
By default, prices are displayed all taxes included (TTC) for individual customers.
Professional customers have the option of displaying prices excluding taxes (HT). The site also allows the user to choose the mode of displaying prices (excluding tax or including tax) for information purposes.
Regardless of the display mode selected, the applicable price, summarized and invoiced at the time of the order, is clearly indicated before final validation, in accordance with the regulations in force.
Payment is due in full at the time of ordering. The order is considered final after acceptance of payment by the banking organizations.
The means of payment accepted are those offered on the site (Visa, Mastercard, American Express bank card or any other means displayed).
The products remain the property of the Seller until full payment of the price.
Article 5 – Delivery
Delivery is free for all orders.
Orders are delivered exclusively in Metropolitan France by the carrier DASCHER.
Orders are prepared after payment has been validated. Dispatch takes place within a maximum period of 48 working hours, unless otherwise indicated on the product sheet or in exceptional circumstances.
Delivery times are given as an indication and are generally between 2 and 6 working days after shipment.
In the event of late delivery, the Customer may request cancellation of the sale under the conditions provided for in articles L216-2 et seq. of the Consumer Code.
Upon receipt, the Customer is required to check the condition of the package and refuse any delivery presenting an apparent anomaly (damaged or open package), by making reservations with the carrier.
Article 6 – Guarantees
The products benefit from legal guarantees and, where applicable, a manufacturer's contractual guarantee.
The contractual warranty covers manufacturing defects for a period of one (1) year, excluding normal wear and tear, misuse, lack of maintenance or non-compliant installation.
When installation is required, it must be carried out by a qualified professional. An invoice may be required for the application of the guarantee.
Article 7 – Legal guarantees
Legal guarantee of conformity
In accordance with articles L217-3 et seq. of the Consumer Code , the consumer benefits from the legal guarantee of conformity.
Guarantee against hidden defects
In accordance with articles 1641 to 1649 of the Civil Code , the seller is bound by the guarantee for hidden defects.
The action must be initiated within two (2) years from the discovery of the defect.
Article 8 – Right of withdrawal (individual customers)
In accordance with articles L221-18 to L221-28 of the Consumer Code, the consumer has a period of fourteen (14) days from receipt of the product to exercise their right of withdrawal.
Return costs are the responsibility of the Customer. Any use exceeding necessary handling may result in a proportional discount.
The refund is made within a maximum period of ten (10) working days from receipt and verification of the returned product.
This right does not apply to professional customers.
Article 9 – Liability
The Seller cannot be held responsible for damage resulting from improper use of the products or non-compliance with the instructions.
Article 10 – Personal data
The data collected is necessary for processing orders.
In accordance with the GDPR, the Customer has the right to access, rectify and delete his data.
Article 11 – Applicable law and disputes
These General Terms and Conditions are subject to French law.
In the event of a dispute, an amicable solution will be sought as a priority. Failing this, the competent courts will be seized in accordance with the rules in force.
